Well, some countries laws, especially USA, are very draconian about copyright, and have very sue-happy companies. The emulation guys are mainly covering their bases, or they would probably have been shut down a long time ago.
It's like our re-translation effort. We're going to be distributing patches for people with the original ISOs (many of which are probably downloaded), rather than a complete patched game.
And, what should be enough, doesn't really count, it's what the Judge decides at the end ^_^, and usually it's the side with the most money and lawyers that wins.
